Chapter 9 - The Second Plan

The note transformed the investigation.
This was no longer only about what had happened at the pool.
Someone had contemplated another attempt.
Police protection around Leo increased immediately.
Emily hated it.
A uniformed officer outside the nursery.
A patrol car beyond the gates.
Security checks before anyone entered.
Leo did not understand.
He laughed at the officer’s radio.
Emily did.
Every new security measure reminded her that someone had written her baby’s name beside the word lose.
Paul Mercer was arrested at O’Hare before boarding his flight.
He requested a lawyer.
Said nothing.
His laptop said plenty.
Investigators recovered encrypted messages between Paul and Victor.
V: D has one job.
P: She’s emotional.
V: She’s committed.
P: If E intervenes?
V: Better. M sees E with the baby.
Emily closed her eyes.
D was Diane.
E was Emily.
M was Michael.
The pool scene had been scripted around predictable behavior.
Victor knew Emily would run to Leo.
Knew Michael was due home.
Knew Diane’s accusation would land before Emily could explain.
They had turned love into mechanics.
Michael read the messages twice.
“Why was I due home?”
Emily looked at him.
“You said your meeting ended early.”
He frowned.
“It did.”
“Who moved it?”
Michael called his assistant.
She checked.
The client had requested a time change after receiving an email from Paul Mercer.
Paul had arranged for Michael to return at the exact window Victor needed.
The deeper problem appeared in another message.
P: If the pool fails, custody route?
V: D has the file. M’s temper helps.
Michael went pale.
The assault.
Victor had expected it.
Maybe not the exact moment.
But he knew Michael’s temper.
Diane had spent months building a file portraying Emily as unstable.
Victor had built another around Michael.
Corporate complaints.
Angry emails.
A security incident where Michael shoved a photographer.
A recorded argument with a contractor.
If both parents could be portrayed as dangerous, Diane might petition for emergency guardianship of Leo.
Emily understood first.
“If Diane got guardianship…”
Michael finished.
“She could control decisions involving Leo’s trust.”
Rachel nodded.
“At least she could attempt to influence trustee proceedings.”
The plot had alternatives.
Plan A: Leo dies, Emily blamed, foundation seeks shares.
Plan B: Leo survives, both parents are discredited, Diane seeks guardianship and trust influence.
No single point of failure.
Emily suddenly remembered Diane smiling after Michael slapped her.
The smile had not merely celebrated Emily’s humiliation.
Michael had done something useful.
“He gave her Plan B,” Emily whispered.
Michael heard.
His face collapsed.
Detective Cole recovered more from Paul’s laptop.
A draft emergency guardianship petition had been prepared three weeks before the pool incident.
It alleged Emily suffered severe postpartum psychological instability.
It alleged Michael had violent tendencies.
It requested Diane Warren be appointed temporary guardian if “an acute family event” endangered Leo.
Rachel read the phrase aloud.
“Acute family event.”
Emily’s stomach turned.
“They prepared paperwork before creating the event.”
Michael walked out of the room.
Emily found him outside near the empty pool.
It had been drained by investigators.
The stone deck remained.
The water was gone.
He stood exactly where he had slapped her.
“I keep seeing it.”
Emily said nothing.
“My hand.”
“Yes.”
“I want to tell you I wasn’t myself.”
“You were.”
He turned.
“That’s what makes it matter.”
Michael nodded slowly.
“I know.”
He looked into the empty pool.
“I gave them something they were counting on.”
“You didn’t make Diane drop Leo.”
“No.”
“You didn’t write the guardianship petition.”
“No.”
“But you hit me.”
“Yes.”
Emily’s voice softened only slightly.
“If you want to be different, stop making your guilt the center of every room.”
He looked at her.
“Then what do I do?”
“Protect Leo. Tell the truth. Accept whatever happens to us.”
That hurt.
“Our marriage?”
“Yes.”
He swallowed.
“Okay.”
It was the first time he had accepted that Emily might leave.
That night Paul Mercer asked to cooperate.
His attorney contacted prosecutors.
Paul claimed Victor had threatened him with evidence of bid-rigging in a prior Warren acquisition.
He said he participated because he believed prison would destroy his family.
Detective Cole asked:
“Who wrote the second-plan note?”
Paul answered:
“Victor.”
“Was there a specific second attempt planned?”
Paul looked toward his lawyer.
Then nodded.
“What?”
Paul swallowed.
“Leo’s medication.”
Emily stopped breathing.
Leo had no serious illness.
But he took prescribed reflux medication twice daily.
Paul said Victor planned to replace it with something that would make the baby critically ill.
Then blame Emily for dosing him incorrectly.
May you like
Police immediately seized every bottle in the house.
One unopened refill had already been tampered with.
